The absence of COVID-19 concerns in this issue is a stark difference from the focus of the December 2021 newsletter, which reported on a spate of challenges to the State's public health orders (PHOs), including the Court of Appeal's judgment in Kassam/Henry, challenges to the validity of the PHOs are taking a back seat.
We expect that, in the coming months, there will be greater focus on emerging challenges related to termination of employment under the PHOs or agency decisions based on like considerations. Most of those challenges are still working their way through the Industrial Relations Commission and the Fair Work Commission.
